Increase of state fees for trademark registration
On 5 October 2024 the Resolution of the Government of the Russian Federation No. 1278 dated 18.09.2024 (hereinafter – the Resolution) came into force, the provisions of which significantly increased state fees for registration of trademark and other intellectual property items.
Let us consider the most important changes.
Cancellation of the 30% Discount
The Resolution abolished the 30% discount on payment of the state fee for electronic filing of applications for a number of Rospatent state services. In particular, the discount was cancelled for actions related to the registration of trademarks and service marks.
Increase of fees
- The fee for registration of application for an invention has been increased from 3,300 rubles to 4,000 rubles.
- The fee for registration of application for utility model increased from 1,400 rubles to 2,000 rubles.
- The fee for registration of application for industrial design increased from 1,700 rubles to 2,000 rubles.
- The fee for registration of invention, utility model, industrial design, publication of information on the grant of a patent and its grant in the form of an electronic document increased from 3,000 rubles to 10,000 rubles.
- The fee for registration of application for trademark has increased from 3500 rubles to 4000 rubles + 1000 rubles for each additional class of ICGS.
- The fee for registration of trademark and issue a certificate in the form of an electronic document increased from 16,000 rubles to 18,000 rubles.
The minimum total fee for the registration of trademark (service mark) has been increased to 35,000 rubles (previously – 21,700 rubles).
New types of legally significant actions
The Resolution introduces new types of legal actions related to an invention, patent, utility model, industrial design, registration of trademark, etc. These actions relate to contesting the legal protection of inventions, industrial designs, trademarks, geographical indications and appellations of origin of goods that have received such protection in the Russian Federation under the terms of international agreements (e.g., paras. 1.27.5, 1.27.8 of the Resolution).
Confirmation of payment or additional payment of a fee
The payment or additional payment of a fee is now confirmed by information from the Public Information System for Regional and Local Payments (GIS GMP) (previously, the document confirming the payment/additional payment of a fee was an order to transfer funds).
Time limits for payment of fees
The additional term for payment of a number of fees related to trademark registration is now 1 month from the date of expiry of the main term (previously, the additional term for payment of fees was 6 months). It is granted subject to an increase in the amount of the fee by 100% (previously 50%).
Compact procedure for registration of trademark
In order to register a trademark more quickly, a right holder can use the compact trademark examination procedure offered by the Federal Institute of Industrial Property. This service includes an accelerated trademark search (within 10 working days) for 45 classes of the ICGS. The full term of trademark registration is reduced to 3 – 3.5 months instead of 6 – 9 months.
The fees for this service are as follows
- Conducting a search on a single word trademark submitted by the client:
For a search within 10 working days, you should pay 94,400 rubles (including 20% VAT).
- Conducting a search on a single figurative trademark submitted by the client:
For a search within 10 working days, you should pay 94,400 rubles (including 20% VAT).
- Search of a combined trademark submitted by the client:
188 800 rubles (including 20% VAT) should be paid for the search within 10 working days.
